New Delhi: The Supreme Court has observed that a
Uniform Civil Code (UCC) is important for ensuring equal rights, especially for
women, across different communities in the country. The remark came during the
hearing of a petition related to inheritance rights under Muslim personal law.
While hearing the matter, the bench pointed out
that many Muslim women still face limitations in inheritance matters under
existing personal laws. The judges noted that a common civil code could help
address such inequalities and provide a more uniform legal framework for
citizens.
During the discussion, the court also raised
questions about what legal system would apply if certain provisions of
Sharia-based inheritance rules were set aside. The bench asked what alternative
structure could replace them if such changes were made.
The judges further observed that inequality in
personal laws is not limited to one community alone and that similar concerns
can be seen in other sections of society, including some tribal groups.
According to the court, addressing these issues requires careful legal
consideration.
The bench also spoke about broader questions
related to family laws in India, including the idea of monogamy and whether the
country has fully achieved a system based on one man and one woman in marriage.
The matter will continue to be examined as the court considers the legal and social aspects connected to personal laws and equality.
